Terms & Conditions

  1. J.R. Basketball Training Lab reserves the right to modify the class schedule at its own discretion. Such modification does not relieve the undersigned of their payment obligations under any circumstances.
  2. J.R. Basketball Training Lab reserves the right to close the gym for public holidays, special events, necessary maintenance (for a period not exceeding four weeks per year) and other purposes without affecting the undersigned of their payment obligations.
  3. By entering into the agreement, the undersigned grants J.R. Basketball Training Lab permission to use photographs, videotapes, artwork or other likeness of the student for marketing, trade, publishing or any other lawful purpose.
  4. Student’s failure to attend scheduled training session(s) does not obligate J.R. Basketball Training Lab to provide replacement lessons at a future date.
  5. Undersigned shall provide an email address to J.R. Basketball Training Lab for billing purposes and acknowledges that e-mail text may include financial information pertaining to the membership.
  6. J.R. Basketball Training Lab reserves the right to change the membership fee with a 30-day advance notification to the undersigned.
  7. J.R. Basketball Training Lab may seek financial reimbursement from the undersigned, for damages caused to our facilities and/or equipment(s) used outside the scope of our training program and/or without supervision or consent from the coaches.

 

Cancellation & Suspension Policy

  1. The membership may be cancelled by the undersigned orJ.R. Basketball Training Lab by providing a one-month notice of cancellation in writing to the other party.
  2. If the membership is cancelled by the undersigned, then J.R. Basketball Training Lab must refund the excess of the membership fee actually paid by the undersigned over the prorated membership fee, in addition to a cancellation fee; but in no event may the prorated membership fee be less than the cancellation fee.
  3. If the membership is cancelled by J.R. Basketball Training Lab, then J.R. Basketball Training Lab must refund the excess of the membership fee actually paid by the undersigned over the prorated membership fee, without any cancellation fee charged against the undersigned.
  4. The membership may be suspended by the undersigned for a one-month period, for a maximum of 2 times a calendar year, without adversely affecting the membership status of the undersigned.Membership fee withdrawals will be temporarily paused during the suspension period. Any excess membership fees already collected by J.R. Basketball Training Lab, shall be credited to the membership.

 

Waiver of Liability

  1. I have enrolled in a program of physical activity, including but not limited to basketball classes to music, shooting balls, ball movement, drills, gameplay and the use of other facilities, services and activities offered by J.R. Basketball Training Lab. I acknowledge that I have either had a physical examination and have been given my physician’s permission to participate, or that I have decided to participate without the approval of my physician. I do hereby assume all responsibility for my participation and activities regarding utilization of equipment, services and facilities offered by J.R. Basketball Training Lab.
  2. I fully understand and am aware that basketball training, including the use of J.R. Basketball Training Lab equipment, services and facilities is a potentially hazardous activity; that fitness activities involve a risk of injury and even death, and that I am voluntarily participating in these activities with the knowledge of dangers involved. I hereby release J.R Basketball Training Lab from any liability now or in the future for any injuries, including, but not limited to, heart attacks, broken bones, sprains, muscle strains, shin splints, joint or back injuries, heat prostration, or any other illness, soreness, or injury, however caused, and any property damage or loss, occurring during or after my use of services, facilities and participation in J.R. Basketball Training Lab.
  3. In consideration of J.R. Basketball Training Lab accepting my application for membership and permitting my use of the facilities, service, and activities offered by J.R. Basketball Training Lab, I hereby agree as follows:
  4. In consideration of J.R. Basketball Training Lab accepting my application for membership and permitting my use of the facilities, service, and activities offered by J.R. Basketball Training Lab, I hereby agree as follows:
    • To waive any and all claims that I have or may in the future have against J.R. Basketball Training Lab and its directors, officers, employees, agents and representatives (all of whom are herein after collectively referred to as “JRBTL”);

    • To release JRBTL from any and all claims of all kind(except as prevented by statute) for any injury, loss, damage, cost, or relief of any kind, resulting from or arising out of or connected with the use of facilities or services or participation in activities offered by JRBTL, including without restriction, claims arising from excessive exertion, from the condition of the equipment or premises or facilities, from the conduct of other members or third parties, and from negligence, including gross negligence, trespass, breach of contract, vicarious liability for any other person’s act or omission, or breach of any statutory or other duty of care, including any duty of care owed on part of JR Basketball;

    • To hold harmless and indemnify JRBTL from any and all liability for any damage to property of, or personal injury to, any third party, resulting from the use of services, facilities, and participation in any J.R. Basketball Training Lab activities;

    • This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity.

  5. I have read and understand and agree with this Agreement. In entering into this Agreement, I am not relying upon any oral or written representations or statements made by JRBTL other than what is set forth in this Agreement. I am aware that by signing this Agreement I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators and assigns may have against JRBTL.
